Today in Southern Labor History in 1938, the Fair Labor Standards Act became law, setting the first federal minimum wage (25¢!), creating overtime pay, a 40-hour workweek, and banning child labor. But it also left out millions of Black and Brown workers — farmworkers, domestic workers, and tipped workers — excluded by design to preserve Jim Crow’s racist economy.
